1. Acceptance of these Terms

These Terms of Service apply to you, an individual who is not acting as a commercial entity, for the purchase of products on the etherys.co.uk website. You and Etherys agree that these Terms of Service will, together with your order as accepted by Etherys, our Privacy Policy, our Refund Policy and our Shipping Policy, constitute the whole agreement between you and Etherys.
Please read these Terms of Service carefully as they contain important information, including information on warranties and limitations of liability. By placing an order through the etherys.co.uk website you acknowledge that you have read and accepted these Terms of Service.

2. Amendments to these Terms

Etherys has the right to amend these Terms of Service from time to time to comply with law or to meet its changing business requirements. Any amendments to the Terms of Service will apply to any order placed after the amended Terms of Service come into effect and are posted on the etherys.co.uk website.

3. Definitions

In these Terms of Service, "Etherys", "we", "us" and "our" means Huzzah Labs Limited, trading as Etherys; "you" and "your" means you, the individual who is ordering the Products; "Products" means the Etherys products which may be ordered on the etherys.co.uk website; and the "Product Subtotal" means the sum of the price of each Product ordered as indicated on the etherys.co.uk website at the time of submitting the order.

4. Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country, state or province of residence, or that you are the age of majority in your country, state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.
You may not use our Products for any illegal or unauthorised purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of these Terms will result in an immediate termination of your Services.

5. Products

The Products covered by these Terms of Service are those presented on the etherys.co.uk website, subject to availability.
We will use reasonable efforts to ensure that any photograph of any of the Products presented on the etherys.co.uk website is as accurate as possible. Please note, however, that the representation of the Products as produced by your computer or device screen may differ from the exact Product.
Our Products are food supplements and cosmetic products. They are not intended to diagnose, treat, cure or prevent any disease. If you are pregnant, nursing, taking medication or have a medical condition, please consult your doctor before using any product.

6. Shipping

Full shipping options, rates and timing are set out in our Shipping Policy. In summary:

United Kingdom: Royal Mail Standard at £1.99, or free on orders of £50 and over.
European Union: Standard International at a flat rate of £14.99.
Rest of World: Standard International at a flat rate of £23.99.
Delivery times stated on the Site and in the Shipping Policy are estimates only. During sale periods and holiday seasons deliveries may take longer.
Products marked as "Pre-Order" at the time of purchase will be dispatched once the Product is available or back in stock.
We are not responsible for any import or customs charges that may be applied prior to you receiving your order.

7. Orders

To submit an order for Products you must either create an account with Etherys on the etherys.co.uk website by registering your details, or complete and submit the online order as a guest. Order acceptance and the completion of the contract between you and Etherys will take place on dispatch to you of the Products ordered, unless we have notified you that we do not accept your order or you have cancelled it.
Etherys reserves the right to refuse any order. Non-acceptance of an order may be the result of one of the following: (a) the Product you ordered is unavailable from stock; (b) our inability to obtain authorisation for your payment; or (c) the identification of a pricing or product description error on the website. In such case, we will notify you as soon as reasonably practicable and refund to you any payment in full.

8. Prices and Payment

All prices on the website are in pounds sterling (GBP) and are inclusive of VAT where applicable. Any change in the VAT rate may be applied to the Products. Prices are subject to change without notice. The price applicable to any order is the price indicated on the etherys.co.uk website at the time of submitting the order.
The amount payable for an order will be the total of (a) the Product Subtotal and (b) the cost of delivery as stated at checkout.
You must pay the order amount at the time of submitting the order. Accepted payment methods include Visa, MasterCard, American Express, Apple Pay, Google Pay and Shop Pay. Payments are processed through Shopify's secure checkout, which uses SSL encryption so that your payment information is encrypted in transit.

9. Liability

Etherys will only be responsible for loss or damage you suffer that is a natural and foreseeable consequence of Etherys breaching its obligations under these Terms of Service. Etherys is not responsible for loss or damage that was not foreseeable, such as damages resulting from your use of the Internet, including the loss of data, any intrusion, virus, service disruption or other unintended issues.
You have sole responsibility for determining the suitability of the Products for the purposes for which you intend to use them.
The Products are supplied for domestic and private use only. Etherys shall not be liable for any losses relating to any business of yours, including lost revenue, income or profits, lost data or any interruption to your business.
You must follow any instructions Etherys may give you in relation to the safe use or storage of the Products. Etherys will not be responsible for any damage to the Products caused by your failure to follow these instructions.
Nothing in these Terms of Service limits any liability of Etherys to you for death or personal injury resulting from negligence, fraud or fraudulent misrepresentation, or any other liability which cannot be limited or excluded under applicable law.

10. Warranty

As a consumer you have certain legal rights, including legal rights relating to any Products that are faulty or not as described. For further information about your legal rights, contact your local Citizens' Advice Bureau or Trading Standards office. Nothing in these Terms of Service will affect these legal rights.
If you receive a Product that is not of satisfactory quality, you can contact Etherys at health@etherys.co.uk for a replacement or, where this is not possible, for a refund.

11. Your right to cancel

As a consumer, you have the right to return the Products, without giving any reason, within 30 days from the receipt of the Products, as set out in our Refund Policy.
If the return of the Products is not because of a Product defect or an error committed by Etherys, you will have to pay the shipping charges for the return of the Products.
If you exercise this right to return the Products, you must return the Products ordered in a condition fit for their resale and in their original packaging.
Etherys will refund you within 7 business days from receipt and inspection of the returned Products.

12. Refunds and Returns

Returns and refunds are governed by our Refund Policy, which forms part of these Terms of Service. Please do not send any Products back without first contacting us at health@etherys.co.uk — we will provide the correct return address.

13. Force Majeure

If Etherys is delayed or hindered in or prevented from performing any of its obligations under any order by reason of any event or circumstance beyond its reasonable control, Etherys will have no liability to you in respect of such non-performance and the time for performing the same will be extended until the event or circumstance has ceased.

14. Personal data

Information provided by you for the order of the Products will be processed by Etherys in accordance with our Privacy Policy. Please refer to our Privacy Policy for further information on the processing of your personal data.

15. Optional tools and third-party links

We may provide you with access to third-party tools and services over which we neither monitor nor have any control nor input. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement.
Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy of such sites and we do not warrant and will not have any liability or responsibility for any third-party materials, websites, products or services.

16. User comments, feedback and submissions

If you send creative ideas, suggestions, proposals, plans, comments or other materials, whether online or otherwise (collectively, "Comments"), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any Comments that you forward to us. We are and shall be under no obligation to maintain any Comments in confidence, to pay compensation for any Comments, or to respond to any Comments.
You agree that your Comments will not violate any right of any third party, including copyright, trademark, privacy, personality or other personal or proprietary right, and will not contain libellous or otherwise unlawful, abusive or obscene material.

17. Other important terms

Etherys may transfer its rights and obligations under these Terms of Service to another organisation.
These Terms of Service are between you and Etherys only. No other person shall have any rights to enforce any of the terms of these Terms of Service.
If any term in these Terms of Service is found to be illegal, invalid or unenforceable by any court or competent authority, the remaining terms will remain in full force and effect.
If you break these Terms of Service and Etherys takes no action, this does not mean that Etherys has waived its rights against you. You will still have to comply with these Terms of Service. Any waiver must be agreed by Etherys in writing.

18. Applicable law

If the place of delivery of the Products is in:
1. England or Wales, these Terms of Service are governed by English law and any dispute or claim arising out of or in connection with their interpretation or execution will be subject to the non-exclusive jurisdiction of the English courts;
2. Scotland, these Terms of Service are governed by Scottish law and any dispute or claim arising out of or in connection with their interpretation or execution will be subject to the exclusive jurisdiction of the Scottish courts;
3. Northern Ireland, these Terms of Service are governed by Northern Irish law and any dispute or claim arising out of or in connection with their interpretation or execution will be subject to the exclusive jurisdiction of the Northern Irish courts.
